    6. data made available commercially by entities that acquire and collect information on the economic situation of enterprises;

    10. data exchanged during the performance of contracts,
    11. Contact details provided by other interested parties, e.g. to recommend you as potential business partners of our organization.
    ■ What are the purposes and legal grounds for processing your personal data and how long will we process this data?
    The contact details processed in connection with the conducted business activities are processed by the Company on the following grounds and for the following purposes (the data retention period is given in brackets):
    1. to the extent necessary to perform the contract (pursuant to Article 6 (1) (b) of the GDPR):
    a. performance of the contract (personal data: on the contract, persons authorized to contact, persons actually performing contacts, data on documents provided under the contract, etc.), including handling possible complaints – (for the period of cooperation);
    b. making settlements between the parties for the performance of the contract – (for the period of cooperation);
    2. to the extent necessary to fulfill the legal obligation incumbent on the Company (pursuant to Article 6 (1) (c) of the GDPR):
    c. fulfillment of accounting obligations – in order to fulfill the obligations arising from the Accounting Act – (for a period of 5 years from the end of the year in which the event occurred);
    d. fulfillment of tax obligations – in order to fulfill obligations resulting from tax regulations, in particular the Tax Ordinance, the Corporate Income Tax Act, the Value Added Tax Act – (for 5 years from the end of the year in which the tax was due) ;
    e. fulfillment of obligations in the field of enforcement of claims – in order to fulfill obligations in the field of enforcement of claims arising from the Code of Civil Procedure, the Act on enforcement proceedings in administration, the Act on court bailiffs – (for a period of 3 years from the last deduction);
    f. fulfillment of the obligation to check the contractor on the so-called The White List of the Ministry of Finance by payment of the invoice issued by him – an obligation resulting from the Tax Ordinance and the VAT Act – (for a period of 3 years);
    g. fulfillment of the obligation to check the contractor in terms of the ability to properly perform the contract – obligations resulting from generally applicable provisions (to the extent that the verification may include personal data) – (for the period of cooperation);
    h. fulfillment of the obligation to provide data to state administration authorities, if such an obligation results from legal provisions; to the extent necessary for the purposes of the legitimate interests of the Company or third parties:
    i. establishing, investigating or defending claims related to the performance of contracts or other business relationships – (until the claims are time-barred pursuant to the Civil Code or other provisions of the rank of the Act);
    j. verification of the contractor before signing and during the contract in order to ensure the security of contract performance – (until the end of cooperation);
    k. conducting the audit;
    l. making and maintaining business contacts – (until the data is no longer useful for the purposes for which it was collected);
    m. implementation of marketing and promotional activities, including contacts with the mass media – (until the data is no longer useful for the purpose or until an objection is raised or consent is withdrawn);
    n. management of the Company’s operations (data included in reports, reports, analytical documents, audits, if the use of these data is necessary for the effective management of the Company) – (until these documents become invalid);
    o. implementation of cooperation and obligations of the Company as a member of an international corporation LG Energy Solution i LG Chem – (until the usefulness of this data is lost);
    p. receiving and sending correspondence – (until the usefulness of this data is lost);
    q. ensuring the safety of the Company: the safety of persons and property as well as information security, in particular the security of IT systems and protection of business secrets in the field of unique production technologies (by, inter alia, recording events in IT systems, internal monitoring using electronic systems, using other measures organizational and technical); (until the usefulness of this data is lost, but no longer than the time limits specified in legal provisions);
    r. investigation, determination or defense of claims.
    In most cases, the data retention period may be extended if the data prove necessary in proceedings pending before a court, a law enforcement authority or an appropriate administrative body, until these proceedings are completed.

    Providing your personal data for the purpose of concluding and performing the contract is voluntary, but it may be necessary for the conclusion and performance of the contract.
    Providing personal data related to the implementation of the Company’s legal obligations is necessary under the law.
    Providing data processed by the Company in connection with the implementation of the objectives resulting from the legitimate interests of the Company or third parties is, as a rule, optional, but failure to do so may prevent you from establishing and maintaining your business relationship with the Company. The following are an exception to this rule:
  • data processed to ensure the safety of the Company (security systems usually record events regardless of the will of the data subject);
  • data processed in connection with the determination, investigation or defense of claims.

    In the process of processing personal data for business purposes, the Company does not use automated decision making, including profiling.

    Courts, law enforcement and authorized administrative bodies – In cases if it is compliant with the law, in particular, if they turn out to be necessary in court, preparatory or administrative proceedings
    ■ Transferring personal data to third countries
    The company, which is an entity related to LG Chem and LG Energy Solution based in Seoul, in the Republic of Korea, may transfer data of persons it processes for business purposes to IT service providers whose infrastructure is located in the Republic of Korea and – as part of, inter alia, reporting and other obligations towards the LG Energy Solution Headquarters – data necessary to fulfill these obligations to the appropriate organizational units in the corporate headquarters. Any transfer of personal data obtained by the Company in connection with its business activities to Korea takes place on the basis of the decision of the European Commission of December 17, 2021, stating that the Republic of Korea ensures an adequate level of protection of such data. In the event that the transfer of personal data concerns third countries that do not have the decision referred to above, the transfer of personal data will take place on the basis of standard contractual clauses.

    ■ What are the purposes and legal grounds for processing your personal data?
    Contact details about senders and recipients of e-mail, data automatically generated by e-mail systems and personal data contained in the content of the correspondence (unstructured data) will be processed by the Company for the following purposes:
    1. enabling e-mail contact with the Company and making contact with addressees,
    2. documenting arrangements made with various stakeholders (customers, business partners, employees, job applicants, officials, etc.),
    3. accept and send letters, notifications, requests, demands, complaints, etc.,
    4. handling complaints, motions and demands,
    5. implementing specific obligations towards state offices, owners and other entities,
    6. sending documents necessary for the proper management of the Company’s business activities (reports, analytical documents, projects, etc.),
    7. managing human resources and other assets of the Company,

    Please be advised that due to the fact that the Company maintains contacts via e-mail, the Company, as a rule, does not process personal data belonging to specific categories of data referred to in art. 9 GDPR (so-called sensitive data) or data on criminal records referred to in art. 10 GDPR. However, if such an obligation will result from legal provisions or the processing of sensitive data will be based on any of the grounds described in art. 9.2 GDPR, the Company will apply appropriate security measures.
    Providing personal data in connection with the exchange of correspondence by electronic means is voluntary, but necessary to achieve the purposes for which digital communication is used

    ■ How long will we process your personal data?
    As a rule, e-mail correspondence will be stored for a period of 6 years, counting from January 1 of the year following the year in which the exchange of correspondence took place.
    The determinant of this period is the expiry of the period of limitation of claims between the parties under the Civil Code (for most contractual relations), but this period may be extended if the data are necessary in court proceedings or before a public administration body.

    ■ Where do we obtain candidates’ personal data from?
    The source of data about candidates may be:
    1. information sent directly by the candidates to the Company, to the addresses dedicated to sending job application documents;
    2. information from people recommending you as a candidate (we require that they recommend you upon your consent);
    3. information provided by employment agencies acting as intermediaries in communication between the employer and potential employees, including enterprises providing the Company with services of searching for candidates to specific positions.
    ■ What are the purposes of and legal basis for the processing of your personal data?
    Your personal data will be processed by the Company for the purpose of recruitment for the position indicated in the job advertisement – in the following stages:
    1. contacting the candidate;
    2. collecting information about the candidate, within the scope specified in art. 22 (1) § 1 of the Labor Code (i.e. first name(s) and surname, date of birth, contact details indicated by the candidate and – if it is necessary to perform work of a given type or at a specific post: education, professional qualifications and previous employment record);
    3. analysis of the candidate’s personal data in order to compare them with the assumed employee profile at the position for which the recruitment is being conducted;
    4. practical verification of the candidate’s skills and abilities, including conducting an interview and / or knowledge and skills tests, if necessary;
    5. negotiating the terms of the employment contract.
    The processing of your personal data during the recruitment process takes place on the following basis specified in the GDPR:
    1. on the basis that processing is necessary for compliance with a legal obligation to which the controller is subject – pursuant to the provisions of law (i.e. Article 22 (1) § 1 of the Labor Code) and to the extent specified therein for purposes related to the recruitment for the position indicated in the job advertisement and for referral to pre-employment health examinations, in the event of a mutual decision to conclude an employment contract (legal basis – Article 6.1 c) GDPR);
    2. on the basis that processing is necessary for the conclusion of a contract, in particular in order to take steps at the request of the data subject prior to entering into a contract (this process is triggered by the candidate’s response to a job advertisement), i.e. in accordance with Art. 6.1 b) GDPR;
    3. based on the consent given by the candidate to the processing of his or her personal data in a scope wider than the scope specified in point 1 above, i.e. in accordance with Art. 6.1 a) GDPR. Sample statement of consent: I give my consent to LG Energy Solution Wrocław sp. z o.o. to process my personal data contained in my recruitment application for the purpose of recruitment for the position this application concerns. Sending the recruitment application will be considered as giving a consent to the processing of such data within given recruitment process;
    4. on the basis of the legitimate interest pursued by the Company, in particular regarding possible exercising or defense of legal claims related to the recruitment process, for the purpose of identifying the candidate in the eRecruiter system (by e-mail address), examining the satisfaction with the recruitment process and regarding the cooperation and settlement of liabilities with a personnel consulting agency, as well as in the event that the Company needs to repeat this recruitment, and for purposes related to the security within the Company’ premises ( legal basis – Article 6.1 (f) GDPR).
    Providing your personal data indicated in the law provisions in order to carry out the recruitment process is necessary to participate in the recruitment procedure. However, providing other personal data is voluntary, and failure to provide it would not have any negative consequences.
    Processing of personal data based on the candidate’s consent – additional information:
    Please be informed that if the processing is based on your consent, you have the right to withdraw your consent at any time. However, this does not affect the lawfulness of the processing before the consent is withdrawn.
    The consent is also the basis for the processing of your personal data after the recruitment for the position for which you applied is completed – provided you have agreed to the processing of your personal data also for the purposes of future recruitment conducted by the Company. Until you withdraw your consent to participate in future recruitments, we will consider your candidacy for other open positions within the Company’s organizational structure. However, if you decide that such data, e.g. about your disability, are the data you want to include in your CV, the Company will process them only based on your consent, which must meet the criteria set out in art. 7 GDPR (in particular, consent must be specific, must be given freely and unambiguously.
    You can withdraw your consent to the processing of your personal data by informing us about your decision in writing (correspondence sent to the address of the Company’s registered office) or by sending an e-mail to the address: rodo.gdpr@lgensol.com .

    ■ How long will we process your personal data?
    The Company stores your personal data until the recruitment for the position you applied for is completed.
    If you have given your consent to the processing of your personal data by the Company for the purposes of future recruitments, we may process this personal data until you withdraw your consent or until the purpose of processing expires (e.g. recruitment failure), but no longer than for a period of 18 months from the date of consent.
    Storage of your data longer than the standard periods indicated above may take place in the following situations:
    1. for the purposes of establishing, investigating or defending against claims related to the recruitment process and preventing abuse – up to the limitation of these claims, if the recruitment process will, in the Company’s opinion, justify the storage of data for such a period;
    2. in case the Company has to repeat this recruitment – until the recruitment is completed;
    3. in order to examine the satisfaction with the recruitment – for a period of 3 months, in order to implement and settle cooperation with a personnel consulting agency – for a period of 12 months;
    4. in the case of participating in a recruitment interview at the premises of the (Company) plant, your data obtained in order to enable entry to the Company’s premises (i.e. your name and surname, telephone number, purpose of the visit) will be kept until the end of the year following the date of the visit, image recorded in the video monitoring system – for a period not longer than 90 days from the date of image consolidation.
    The Company will erase your personal data immediately when the purpose of the processing is achieved or the storage period expires, unless the retention of personal data is necessary or results from the provisions of law.
    ■ Automated decision making, including profiling
    The Company does not use automated decision-making, including profiling, which would have a legal effect on candidates or would similarly refer to them. The Company will give you an advance notice of the legitimacy, necessity and expected results of automated decision-making if the Company would plan to implement such a system.
    ■ Who can we share your personal data with?
    The Company discloses personal data to third parties in accordance with:

    Recipient – Purpose

    Entities within the LG Energy Solution and LG Chem Group – Information, analytical and control purposes, human resources management, administrative purposes
    Entities recruiting at the request of the Company or providing appropriate IT tools to conduct recruitment processes, including communication with the candidate – Provision of services related to recruitment
    Medical services entities – Provision of medical services – pre-employment health examination
    Entities dealing with the protection of persons and property – Ensuring the safety of people and property, in particular by controlling entrances / exits and movement of people within the Company’s premises
    Postal operators and courier companies – Traditional exchange of correspondence

    In addition, depending on the circumstances, the candidates’ data may be transferred to other entities, e.g. providing services to the Company, such as job advertisement publishing service providers, recruitment management system providers, IT service providers, legal and advisory service providers, as well as to the extent necessary to fulfill obligations resulting from legal provisions, e.g. to state authorities. We would also like to inform you that if the recruitment is carried out with the participation of other entities undertaking the recruitment activities, they may act as a separate data controller (they define separately the purposes and method of your personal data processing).

    ■ Transferring personal data to third countries
    The administrator, who is a subsidiary of the LG Energy Solution and LG Chem Ltd. corporation based in Seoul, the Republic of Korea, may transfer personal data of job applicants to the above-mentioned entities for organizational and administrative purposes. Any transfer of personal data of job applicants to Korea takes place on the basis of the decision of the European Commission of 17 December 2021 stating that the Republic of Korea ensures an adequate level of protection of these data.

    ■ What are your rights in relation to the processing of your personal data by the Company?
    In connection with the processing of personal data, as a job applicant, you have the right to request: :
    1. access to personal data, including obtaining from the Company confirmation whether the personal data of the candidate are processed, and if so, obtaining access and information about this data, on the terms set out in Art. 15 GDPR;
    2. rectify or supplement incorrect or incomplete data, in accordance with the principles set out in Art. 16 GDPR;
    3. erase data if the Company no longer has a legal basis for their processing or personal data are no longer necessary for processing purposes, on the terms set out in Art. 17 GDPR;
    4. restriction of data processing under the terms of art. 18 GDPR;
    5. transmit the data provided on the basis of consent, on the terms specified in Art. 20 GDPR.
    6. object to the processing of data for the legitimate purposes of the Company, for reasons related to the special situation of the candidate, on the terms set out in Art. 21 GDPR.
    To exercise the above-mentioned rights, you should contact the Company in writing (correspondence sent to the address of the Company’s registered office) or by sending an e-mail to the address: rodo.gdpr@lgensol.com and inform you which right and to what extent you want to exercise.
    At the same time, we would like to inform you that the Company, in the situations specified in the GDPR, may refuse to implement some of the above-mentioned rights, in particular if:
    1. the request comes from a person other than the data subject, unless that person is a duly authorized representative,
    2. the person submitting the application cannot be clearly identified,
    3. processing is necessary to establish, exercise or defend legal claims.
    ■ The right to lodge a complaint with the supervisory authority
    If you believe that your personal data is processed contrary to applicable law, you can file a complaint with the supervisory authority, which in Poland is the President of the Personal Data Protection Office [Prezes Urzędu Ochrony Danych Osobowych] with its seat at Stawki street 2, 00-193 Warszawa. However, before you submit a formal complaint or take any legal action, we suggest that you contact us to clarify any doubts and / or objections regarding the processing of your personal data.
